General commercial conditions

1. CONCLUSION OF THE CONTRACT

Czech holidays - cestovní kancelář s.r.o. (further called as Czech Holidays) offers to you (further called as clients) a non-binding offer, which is based on options followed by bookings, where everything is done in written form. After successful booking the travel information are sent to the clients within approximately 14 days.

2. PAYMENT

After confirmation a deposit is required, full payment is required 15 days before departure. Travel information and other travel documents will be sent only after receiving the whole payment. The client is obligated to pay the whole agreed amount incl. all banking costs. When paying by check, we increased the amount by 2%.

3. SERVICES

Specifications of the ordered services in the application are obliged for the range of negotiated services. Extended services in addition to the contract are obliged after written confirmation of Czech Holidays.

Czech Holidays is responsible in range of its duties as an orderly buyer for:
a. conscientious preparation of the tour
b. careful selection and control over providers of services
c. correctness of services description
d. proper fulfilment of the negotiated services in range of local and territorial customs.

Czech Holidays is not responsible for failures in services provided by other subject (for example transfer, public transport, flights, shipping, boat rides, rides with cable cars, cultural events etc.).

4. CHANGES OF THE ORDERED SERVICES AND PRICES

Differences of any of the contract articles, originated from serious reasons after its concluding, not caused and not influenced by Czech Holidays, are admissible just in case that it doesn’t essentially affect the whole tour. If it is possible, Czech Holidays informs the clients about the changes. Increase of prices caused by detachedly entitled and unpredictable reasons (change of taxes, fees, petrol prices) is possible up to 40 days before the arranged beginning of the stay in the range which qualifies the price change. If the increase of the price is higher than 5%, the customer is allowed to cancel the contract without any charge within 10 days. In case the change would affect substantially the negotiated services, the customer is allowed to resign from the contract free of charge unless the stay has not been started, or to negotiate other service.

5. CANCELLATION BY THE CLIENT

The client is allowed to cancel the contract any time before the departure by written explanation. Apart from a processing fee of € 25,- per booking following cancellation charges will be applied:
Not later than 32 days before arrival - 15% of the price for ordered services (min. € 25,- per booking).
31 - 22 days before arrival - 30% of the total price per person
21 - 14 days before arrival - 50% of the total price per person
13 - 07 days before arrival - 70% of the total price per person
06 - 0 day before arrival - 100% of the total price per person

Decisive term for the cancellation fee is the day, when a written form was delivered to Czech Holidays.

For any changes in the booking a fee in the amount of 5 % of the total price (min. € 25,- per booking) will be charged.

6. CANCELLATION OR TERMINATION BY THE CUSTOMER OR CZECH HOLIDAYS

If continuance of the tour is endangered or impaired as a consequence of unpredictable extraordinary circumstances, for example natural disasters, accidents etc., the contract can be cancelled by both parties.

Czech Holidays can terminate the contract any time, when one of the partners fails to provide promised or alternate accommodation. The customer will get back the full price, any other demands are not acceptable.

7. UNUSED SERVICES

Czech Holidays will not refund charge for negotiated and unused services. Exceptions are acceptable just for unpredictable circumstances or if the services are not provided as written in the contract.

8. WARRANTY CLAIMS, COMPLAINTS, OBLIGATIONS OF CUSTOMER

If negotiated service from Czech Holidays is not provided at all or not in agreed form, the customer is allowed to demand compensation. The customer is obliged to inform about defects immediately in order to avoid conditioned damages, or to help to minimize them. The customer is also obliged to report defects to the leader of the tour or to the representative of our provider (especially in hotels) without any delay. If complaints will not be reported or will be reported belatedly, any demand of compensation expires. Claims for non-contractual provision of trip must be submitted within 4 weeks after completion of the trip.

9. PRICE REDUCTION

The customer is allowed to demand price reduction in case that announced defects in agreed services were not removed at all or were not provided in agreed quality.

10. COMPLAINS

The EU- commission prepares platform for out-of-court settlement. This will give an option to customers to solve disputes relating to their on – line order without engagement of the court. This platform is accessible under following external link: ec.europa.eu/consumers/odr/.

11. PASSPORT, VISA, CUSTOMS, CURRENCY AND HEALTH REGULATIONS

For EU-fellow citizens (with no special features as double citizenship etc.) the EU-regulations are valid.

Non-EU citizens are obliged to get informed about the regulations of entry to the EU or to the Czech Republic before the journey. Czech Holidays is not responsible to pay the cancellation fee in case of misunderstanding, oversight or disrespecting the entry conditions to the EU. Czech Holidays guarantee maximal cooperation in the process of getting entry visas and fulfilment of all conditions for entry to the EU.

Czech Holidays informs the non-EU citizens about their responsibility for all rules related to the tour (passport, visa, customs and health instructions). Customer pays all damages, especially payment of expenses caused by disobeying of rules.

12. INVALID PARTS OF THE CONTRACT

Invalidity of parts of the contract does not mean that the entire contract is invalid. Invalid parts have to be replaced by valid ones.

13. OTHERS

All facts on the Internet correspond to the state valid in time of creating the web pages. Czech Holidays reserves the right to change services and prices as a consequence of errors and faults. The increase of prices, raised after time of creating the web pages allows Czech Holidays to make corresponding adjustment.
